What factors influence the sentencing of child pornography?
That is why I have used my statutory powers to request data, and for the first time collected case files on child-on child sexual abuse from one police force and from one Sexual Abuse Referral Centre (SARC), where children had been referred because they had been sexually abused by another child. My office has carried out innovative analysis of the text these documents to understand more about the role that pornography might play at this sharpest end of child abuse cases. And whilst industry may have heaved a sigh of relief on completing their first OSA risk assessments this year, Ofcom is not standing still. Pornography platforms in particular are required to implement HEAA to prevent children accessing the entire site. For more mainstream services, once child users have been identified providers have a duty to protect them from encountering harmful content, including porn, bullying content, and content which encourages eating disorders, or dangerous challenges or stunts. To do so, these services must detect this content, and remove it from parts of the site which can be accessed by child users, or by users whose age has not been verified.

Types of content the Act tackles
270.Section 137 makes the modifications needed for provisions in Part 2 of the Act relating to court orders, convictions, findings, offences and proceedings to apply in the context of service courts (that is, courts-martial and Standing Civilian Courts) as well as in civilian courts. Service courts have jurisdiction to try all offences equivalent to an England and Wales criminal offence, including the most serious, committed outside the UK, and most such offences committed within the UK, by persons subject to Service law. These persons include Service personnel and, in limited drugs circumstances, some groups of civilians, such as dependants or civil servants accompanying the Services overseas. Section 137 makes clear, for example, that if a person is convicted of a serious sexual offence by a court-martial, that person will be subject to the notification requirements. It also enables Service courts to impose sexual offences prevention orders at the time of sentencing in the same way as civilian courts. Where a Service court is satisfied that the test set out in section 104(1)(b) is met, namely that a sexual offences prevention order is necessary for the purposes of protecting the public in the UK from serious sexual harm, that court will be able to impose such an order in the same way as a civilian court.

This report contributes to the literature on pornography’s role in shaping and fuelling violence against women and girls.i The risk factors behind harmful sexual behaviour and children abusing other children are complex, with pornography being one possible factor among others. My first report, published in January 2023, “A lot of it is actually just abuse”, set out findings from a survey of over a thousand year-olds and focus groups with teenagers. It established that the average age at which children first view pornography is now 13 years old. Substantial proportions of young people surveyed who had seen pornography viewed it at a much younger age than 13 – 27% by age 11 and 10% by the age of 9. Young people spoke about the unbearable pressure to view hardcore pornography even if they do not want to, much of which depicts degrading acts and violence against women.
